Summary:  The City of Clovis has submitted a request for a finding of consistency from the Fresno County Airport Land Use Commission (ALUC) for the Infill Rezone Program. The project consists of a General Plan Amendment and rezone to High and Very High-Density Residential land use designations and to the R-3 and R-4 multi-family zone districts to facilitate additional residential development capacity on 20 infill sites throughout the city.

Of the 20 sites included in the program, five are located within the Airport Influence Area (AIA) of Fresno Yosemite International Airport. These sites are located within Zone 6, Traffic Pattern Zone (TPZ). No physical development is proposed as part of this application.

The project is intended to comply with State housing requirements and a court-ordered judgment by increasing opportunities for multi-family residential development. The program would create capacity for approximately 1,303 dwelling units.

While no development is proposed at this time, future development within the TPZ will be subject to applicable ALUCP safety, height, and airspace protection requirements, including the requirement for an Airport Disclosure Notice.

Airport Compatibility Considerations:

Within Zone 6 – Traffic Pattern Zone (TPZ), the aircraft accident risk level is considered to be low. Based on the ALUCP safety criteria, the project does not propose physical development; however, the proposed rezones would allow for increased residential density on the subject sites. As such, future development may introduce additional population within the AIA.

Within the TPZ, residential uses are permitted; however, development must comply with applicable safety, density, and airspace protection criteria. Generally, there is no airspace concern for structures under 100 feet in height; however, structures exceeding 100 feet would require additional airspace review and FAA notification. As this is a rezone action without a specific development proposal, consistency with ALUCP safety criteria should be evaluated at the time of future project-level review.

Additionally, prohibited uses within Zone 6 include outdoor stadiums and similar high-intensity uses, as well as hazards to flight such as physical, visual, or electronic interference with aircraft operations, and land uses that may attract wildlife, including those identified in FAA Advisory Circular 150/5200-33B. An airport disclosure notice will be required for future development.

Noise Contours: The project sites are not located within Fresno Yosemite International Airport’s noise contours; therefore, no noise compatibility concerns are anticipated.

Action: ALUC staff recommends the Fresno County Airport Land Use Commission to approve a Finding of Consistency for the City of Clovis Infill Rezone Program Application.

Summary:  The City of Fresno has submitted Rezone Application No. P26-00729 requesting a finding of consistency from the Fresno County Airport Land Use Commission (ALUC). The project pertains to approximately 3.30 acres located on the south side of East Barstow Avenue, west of North Fresno Street (251 East Barstow Avenue).

The application requests authorization to remove existing conditions of zoning on the subject property, allowing for future residential development consistent with the RM-1 (Residential Multi-Unit, Medium High Density) zone district. No physical development is proposed as part of this application.

Airport Compatibility Considerations:  The project site is located within the Airport Influence Area (AIA) of Fresno Yosemite International Airport, specifically within Zone 7, Precision Approach Zone (PAZ). The aircraft accident risk level is considered to be low within the PAZ.

Based on the ALUCP safety criteria, the project does not introduce new development or intensification of land use. As this is a rezone action without a specific development proposal, consistency with ALUCP safety criteria will be evaluated at the time of future project-level review.

Within Zone 7, there is generally no airspace concern for structures under 100 feet in height. Additionally, land uses that may create visual, electronic, or wildlife hazards to aircraft are not permitted within the Airport Influence Area. While no structures are proposed as part of this application, any future development will be required to comply with applicable height and airspace protection standards.

While the project site is located within the Airport Influence Area, an Airport Disclosure Notice is not required at this time. However, consistent with ALUCP Section 3.5 and state law, disclosure requirements would apply to any future residential development at the time of property sale or lease.

Noise Contours:  The project site is located within Fresno Yosemite International Airport’s noise contours (Forecast (2022) NEM Contour (60 dB CNEL)). It appears that this residential project type is permissible within this contour.

Action:  ALUC staff recommends the Fresno County Airport Land Use Commission to approve a Finding of Consistency for Rezone Application No. P26-00729.
